Rome Statute, hindi kailanman umiral sa Pinas- Pangulong Duterte

SINABI ni Pangulong Rodrigo Roa Duterte na hindi nailathala sa Official Gazette ang ginawang paglagda ng Pilipinas sa Rome Statute, nagtatag sa International Criminal Court (ICC), kaya’t maituturing na hindi ito kailanman umiral sa bansa.

 

“The executive department has no copy. That’s because what happened was from Congress — Congress ratified it — instead of returning the treaty as ratified by Congress to the executive department, they short-circuited it. They went straight to Rome and appended the Philippine participation,” ayon sa Pangulo sa kanyang Talk to the People, Miyerkules ng gabi.

 

“There’s no publication in the Official Gazette. When there’s no publication, there’s no jurisdiction. There’s no recorded publication. According to the Supreme Court, the absence of a publication in the Official Gazette is always fatal,” dagdag na pahayag ni Pangulong Duterte.

 

Taong 2018 nang magdesisyon si Pangulong Duterte na kumalas ang Pilipinas bilang signatory sa Rome Statute na kumikilala sa International Criminal Court (ICC) matapos siyang pagtulungang atakihin at batikusin ng United Nation (UN) special rapporteur Agnes Callamard at UN High Commissioner on Human Rights Zeid Raad al-Hussein kaugnay sa sinasabing paglabag nito sa karapatang pantao kaugnay ng inilunsad na drug war ng gobyerno at palabasing masama ang kanyang imahe at walang-puso na lumalabag sa karapatang pantao.

 

“The attempt to place me under the jurisdiction of the ICC is a brazen display of ignorance of law. The ICC has no jurisdiction nor will it acquire jurisdiction over my person,” giit pa ni Pangulong Duterte.

 

“The very conside­rations upon which the PH agreed to be a signatory to the Rome Statute have not been observed nor complied with hence the PH hereby withdraws from the Rome Statute,” dagdag na pahayag nito.
