Implikasyon ng naging desisyon ng Korte Suprema sa JSMA sa China, Vietnam, pag-aaralan ng DoE

PAG-AARALAN ng  Department of Energy (DOE)  ang naging  desisyon at implikasyon ng  Supreme Court (SC) ruling sa Joint Marine Seismic Undertaking (JMSU) sa China at Vietnam na sinasabing  “void at unconstitutional.”
Sa isang kalatas, sinabi ni DOE Undersecretary Alessandro Sales na titingnan nito ang nasabing desisyon, makikipag-ugnayan sa kinauukulang ahensiya ng pamahalaan para sa kung paano susulong gamit ang ruling.
“The DOE will work closely with the Office of the Solicitor-General and the Department of Justice in determining the next steps to be taken on the matter,”  ani Sales.
Sa ulat, natuklasan kasi  na ang ipinalabas na  desisyon ng Korte Suprema noong Enero 10, 2023  ay unconstitutional JMSU sa Agreement Area sa  South China Sea, dahil  “it allowed wholly-owned foreign corporations to explore the country’s natural resources.”
Ang JMSU—pumasok sa 2005 at napaso’ noong 2008—ay isang kasunduan ng Philippine National Oil Company (PNOC),  China National Offshore Oil Corp., at Vietnam Oil Gas Corp., may kinalaman sa  142,886 square kilometers sa South China Sea.
Nag-ugat ang kaso mula sa petisyong inihain nina dating Bayan Muna Party-List representatives Satur Ocampo at Teodoro Casiño, kapuwa iginiit ng mga ito na ang  JMSU ay illegal dahil nilabag nito ang 1987 Constitution kung saan  “reserves the exploration, development, and utilization of natural resources to Filipinos or corporations which are 60% owned by Filipinos.”
Samantala,  buwan ng Nobyembre ng nakaraang taon, inamiyendahan ng DOE  ang seksyon ng  implementing rules and regulations (IRR) ng Renewable Energy (RE) Act of 2008, pinapayagan ang  foreign investors o mga kompanya na ma- engage sa “exploration, development, at utilization” ng Philippine renewable energy sources.
