Pulis ‘guilty’ sa homicide ng 17-anyos na napagkalamang suspek

HINATULANG nagkasala ng Navotas Regional Trial Court (RTC) Branch 286 ang pulis na si PSSg. Gerry Maliban sa menor de edad na napatay sa isang “mistaken identity” case habang mapaparusahan din ang apat na pulis sa pagpapaputok ng baril.
Martes nang ilabas ng Navotas court ang hatol kaugnay ng pagkamatay ni Jerhode Jemboy Baltazar matapos mapagkamalan sa isang police operation sa Barangay North Bay Boulevard South Kaunlaran.
“The Court likewise finds accused PSSg Gerry Maliban y Sabate guilty beyond reasonable doubt o the crime of Homicide defined in Article 249 of the Revised Penal Code,” wika ng desisyong pinirmahan ni Presiding Judge Pedro Dabu Jr.
“There being an incomplete justifying circumstance of performance of duty and the presence of voluntary surrender… the Court sentences Gerry Maliban y Sabate to suffer an indeterminate prison term of Four (4) years, two (2) months and ten (10) days of prision correccional medium as minimum, to six (6) years, four (4) months and twenty (20) days of prision mayor minimum as maximum and to pay the heirs of Jerhode jemboy Baltazar and the sum of Fifty Thousand Pesos (P50,000.00) as civil liability and the further sum of Fifty Thousand Pesos (P50,000.00) as moral damages.”
Hinatulan din ng guilty para sa kasong “illegal discharge of firearms” ang apat pang pulis kaugnay ng pagkamatay ng teenager:

PCpl. Edward Jade Blanco
Pat. Benedict Mangada
Makukulong ng apat na buwan at isang araw na pagkakakulong sina Balais, Esquilon, Blanco at Mangada dahil sa paglabag ng paragraph 2 ng Article 254 ng Revised Penal Code, bagay na inamyendahan ng Republic Act 11926.
Sa kabila nito, napawalang-sala naman si PSSg. Antonio Bugayong sa anumang pananagutan kaugnay ng kaso.
Una nang inuugnay si Bugayong sa pagpapaputok ng baril kasama ang kanyang mga kabaro sa gilid ng isang dike, ngunit una nang sinabi ni Jemboy na hindi siya ng “matabang” nagpaputok.
“PSSg Bugayong Jr. did not admit before the Senate Investigation that he fired his gun. The paraffin test conducted on his firearm yielded negative result for gun powder,” dagdag ng desisyon.
“Although the absence of a gun pow[d]er is not a conclusive evidence that the gun was not fired, yet the negative result of gun powder is a corroborative evidence. With all these evidence, there is doubt that PSSg Bugayong fired his gun.”
Dahil dito, pakakawalan na si Bugayong sa pagkakakulong maliban na lang kung mayroon pa siyang ibang kaso.
Una nang sinabi ni PCol. Allan Umipig, hepe ng Navotas City police, na hindi binuksan ng sangkot na pulis ang body camera habang nangyayari ang pamamaril sa bata.
Matatandaang ikinagalit don noon ni Roda Baltazar, ina ni Jemboy, ang pagpigil diumano ng mga pulis sa kanila para makuha ang bangkay ng kanilang anak.
Agosto noong nakaraang taon lang nang sabihin ng National Union of People’s Lawyers-National Capital Regionna nagpakita ng “intent to kill” ang mga pulis, kung kaya’t sapat daw ang pagkakaso ng murder imbis na “reckless imprudence resulting in homicide.”
Kinundena ng grupong Karapatan ang diumano’y “palusot” ng Navotas police bilang “flimsy excuse,” ito habang idinidiing dapat mag-exercise ng due dilligence ang mga otoridad sa paghabol ng mga suspek. (Daris Jose)
