BBM, Comelec pinasasagot ng SC sa DQ case

PINASASAGOT ng Supreme Court (SC) ang kampo ni presumptive President Ferdinand “Bongbong” Marcos Jr. at ang Commission on Elections (Comelec) ukol sa iniakyat sa kanilang disqualification case laban sa una.
Bukod sa kanila, pinasasagot din ng SC ang Senado at ang House of Representatives, na isinampa sa petisyon na isinumite nina Fr. Christian Buenafe at iba pa.
Sa En Banc Resolution na may petsang Mayo 19, 2022, pinasasagot ang mga respondents sa loob ng 15 araw makaraang matanggap ang ‘notice’ ukol sa mga alegasyon na hindi nabigyan ng tamang proseso ang petisyon na isinampa sa Comelec laban kay Marcos.
“WHEREAS, considering the allegations contained, the issues raised and the arguments adduced in the Petition, without necesssarily giving due course thereto, it is necessary and proper to REQUIRE the respondents to COMMENT on the petition and prayer for temporary restraining order,” ayon sa SC.
Sa inihaing petisyon noong Mayo 16, kinuwestiyon ng grupo nina Buenafe ang mga resolusyon ng Comelec na may petsang Enero 17, 2022 at Mayo 10, 2022, na nagbabasura sa petisyon nila kontra kay Marcos.
Nakasaad sa kanilang petisyon na nararapat na tanggihan o kanselahin ng Comelec ang inihaing ‘Certificate of Candidacy’ ni Marcos para sa posisyon ng Pangulo ng bansa.
Ikinatwiran ng grupo ni Buenafe na nakagawa ng krimen ukol sa ‘moral torpitude’ at perjury si Marcos dahil sa maling nakalahad sa kanyang COC sa kanyang ‘eligibility’ sa pagtakbo kaugnay sa kaso ng hindi pagbabayad ng buwis. (Daris Jose)
